CHRISTMAS FOR VETERANS GIVEAWAY RULES

NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OR PAYMENT DOES NOT IMPROVE THE ODDS OF WINNING. Odds of winning are based upon the number of eligible entries received. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

The Christmas for Veterans Giveaway (“Giveaway”) is being sponsored by The Home Loan Expert, LLC d/b/a HERO.LOAN, located at 1600 South Brentwood Blvd., Suite 700, St. Louis, MO 63144 (“Sponsor”).

ELIGIBILITY: To be eligible to win the Giveaway, the winner must be individuals who (a) are legal residents of the contiguous United States; (b) are serving in the United States or overseas, or have served in the active duty, National Guard or Reserve components of the Army, Navy, Marine Corps, Air Force, or Coast Guard and, if discharged or released, have an honorable discharge; (c) agree to be bound by the terms and conditions of these Official Rules; and (d) be 18 years of age or older as of date of entry. Proof of eligibility, including proof of military service, may be required before an Entrant or Nominee can be declared a Winner of the Giveaway. Employees of Sponsor and any other organizations affiliated with the Giveaway and each of their respective parents, agents, affiliates, subsidiaries and advertising and promotion agencies, and members of their immediate family (regardless of where they reside) or household members, whether or not related, are not eligible to enter or win the Giveaway.

ENTRY PROCESS: Entrants will be allowed to register themselves or a nominee on an online portal managed by Sponsor at: https://heroloan.com/hero-loan-veterans-day-giveaway/ (“Entry”). One Entry allowed per Entrant. Entry must include the Entrant’s full name, email address, age, and optional story about why the veteran deserves to win. If the Entry is a nomination, the Entry must include the full name of the nominee

as well. Only fully completed Entries will be allowed. Entries cannot be returned and become the sole property of Sponsor. By submitting an Entry or accepting a prize, Entrants and/or the Winner accepts and agrees to be bound by these Official Rules and the decisions of the Sponsor. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Giveaway or these Official Rules without liability and without prior notice at any time, subject to state and federal law. Sponsor is not responsible for lost, misdirected, late, unsent, incomplete, illegible or unintelligible Entries or nominations or for inaccurate information, whether caused by Entrant or by any of the equipment or programming associated with or utilized in the Entry, or by any technical or human error that may occur in the transmittal of any Entry. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the Entry process or the operation of the Entry process; to be acting in violation of these rules; or to be acting with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all such entries submitted by such methods.

ENTRY PERIOD: The Entry Period starts at 12:01 a.m. Central Daylight Time (“CDT”) on November 9, 2020 and ends at 5:00 p.m. CDT on November 15, 2020 (“Drawing Period”). All Entries must be received between November 9, 2020 at 12:01 a.m. CDT and 5:00 p.m. CDT on November 15, 2020. Sponsor’s computer is the official timekeeper for the Giveaway. Odds of winning are dependent on the number of eligible Entries received. Three winners will be randomly drawn under the supervision of Sponsor and will be recorded on Facebook Live on or about November 15, 2020, at approximately 5:00 p.m. CDT, from all eligible Entries received during the Entry Period for receipt of one Prize each, as defined below (the “Winner” or “Winners”). The Winner or the Entrant will be notified by any or all of the following means after the random drawing: By email at the email address provided in the Entry; by tagging the winners in the Facebook post announcing the winners; and by sending

them a message through Facebook after the random drawing. Winner must respond fully and accurately to Sponsor’s notification within seven (7) days from time of notification, providing any proof of eligibility required by the Sponsor, in order to claim the Prize, as detailed below, and must meet all other eligibility requirements in order to be declared the Winner. Sponsor shall not be responsible for any delay or failure to receive notification for any reason, including but not limited to an inactive email account, technical difficulties or the failure to actively monitor any email account by Entrant. The Winner may be required to provide proof of eligibility and return an executed affidavit of eligibility, release of liability, publicity release by a date certain and information for completion of a 1099 US tax form. Any Winner notification not properly answered or met or returned as undeliverable may result in forfeiture of Prize, as detailed below, and an alternate Winner will be randomly selected by Sponsor.

Prize: One gift card will be provided to each of the three Winners, as follows: one American Express Gift Card with a purchase value of One Thousand Dollars ($1,000.00) including delivery, processing & handling fees (the “Prize”). All taxes and any other applicable fees of any type related to receipt or use of the Prize shall be born solely by Winner. No transfer of Prize is permitted. Prize cannot be awarded in cash. Sponsor will not replace any lost or stolen Prize. Prize is awarded “as is” with no warranty or guarantee, either express or implied, other than any retail warranty that covers Prize. The depiction of the Prize in any advertising or promotional materials may not reflect the actual Prize delivered to the Winner. Sponsor will determine all features of Prize, including, but not limited to, card design, expiration date, and all other features of the Prize. Sponsor shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the Prize or use of the Prize provided pursuant to the Giveaway and/or any person’s participation in the Giveaway. The Winner must take delivery of

Prize by Sponsor’s designated method. Sponsor shall not be responsible for delays in delivery of the Prize, and delivery is subject to availability. Sponsor, however, shall use all reasonable efforts, subject to availability, to deliver the Prize within one hundred twenty (120) days of completion of verification process. Sponsor reserves the right to substitute the Prize for one of comparable or greater value, at its sole discretion. Winner is responsible for all taxes and other costs and fees associated with Prize receipt and/or use not specified herein as being awarded.

GENERAL RULES: The decisions of Sponsor are final with respect to all matters relating to this Giveaway, and participants agree to be bound by these Official Rules. In no event will Sponsor be liable for more than the stated retail value of the Prize. Participation in the Giveaway constitutes permission to use Entrant’s name, likeness, voice, address (city and state), and statements and/or testimonials in all media, now or hereafter known, throughout the world in perpetuity, in any manner Sponsor deems appropriate without any further compensation or notification to or permission of the respective Entrant, unless prohibited by applicable law.

LIMITATIONS OF LIABILITY: The Sponsor reserve the right to terminate, cancel, suspend and/or modify the Giveaway without liability and without prior notice. By participating in the Giveaway, Entrants agree: (a) to comply with these Official Rules and the decisions of Sponsor, which shall be binding and final in all respects; (b) to release the Sponsor and Sponsor’s employees, officers and directors, affiliated companies, parents and subsidiaries and any advertising agency or other company involved with the design, production, execution or distribution of this Giveaway from all liability, loss or damage arising out of participation in the Giveaway or in connection with the awarding, receipt, possession, use and/or misuse of any prize; (c) to be contacted by Sponsor by mail, telephone and/or email; (d) that this Giveaway is in no way sponsored, endorsed or administered by or associated with

Facebook, Twitter or Instagram; and (d) that he/she acknowledges that Sponsor does not make any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any Prize and disclaims all liability for the provision, quality or nature of any third-party products or services provided to the Winners. Except where prohibited, each Entrant and Winner accepting a prize agree that: (a) all issues and questions concerning these rules shall be governed by Missouri law without giving effect to any principles of conflicts of law of any jurisdiction; (b) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this program or any prize awarded shall be (i) resolved individually, without resort to any form of class action; and (ii) filed only in the state courts situated in Missouri, and Entrant and Winner hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (d) under no circumstances will any Entrant or Winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

PRIVACY: Sponsor will be collecting personal data about Entrants and nominees in accordance with its privacy policy. By participating in the Giveaway, you hereby agree to the Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy.
